Terms of Service
The short version
- EduMock is a tool for schools to run BECE mock exams. Super Admin approves each school before it can use the portal.
- Your school owns its student data and is responsible for having the right to add it, including telling parents and getting consent where required.
- Use the Service honestly: enter true marks, keep passwords private, and do not misuse other people's data.
- Mock results are practice results. They are not WAEC or Ghana Education Service results.
- We work hard to keep the Service running and safe, but we cannot promise it will never have errors or downtime. Our liability is limited as set out below.
1. About these terms
These Terms of Service ("Terms") are an agreement between EduMock Educational Publications ("we", "us", trading as EduMock) and the school or organisation that registers for the EduMock website and portal (the "Service"), and each person who uses it on the school's behalf ("you"). By ticking the acceptance box, creating an account, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
If you accept for a school, you confirm that you are authorised to bind the school to these Terms. Agreeing electronically is valid under the Electronic Transactions Act, 2008 (Act 772), and we keep a record of when and by whom the Terms were accepted.
2. Accounts and approval
- A new school portal is created by a school administrator and must be approved by Super Admin. We may refuse or withdraw approval, for example where details look false or duplicated.
- Give accurate information and keep it up to date.
- Keep your password confidential and sign out on shared devices. You are responsible for activity under your account unless you tell us promptly that it has been compromised. Tell us at privacy@example.com.
- The school administrator decides who else at the school gets an account and what role they have, and must remove accounts of people who leave. Accounts are personal and must not be shared.
3. The Service
The Service lets approved schools register students, enter or upload scores, review and submit them, and receive published mock results, slips and analysis. Which mocks a school can use is decided by Super Admin. Some features (such as teacher accounts and a school's own grading scale) belong to the optional Pro plan (see section 8). We may add, change or remove features, but we will not remove paid features during a paid period without a fair remedy.
4. What schools must do
The school is responsible for:
- the accuracy of the student details and scores it enters, and for checking them before submitting them for grading;
- having a lawful basis for adding each student, and informing parents or guardians about the processing and obtaining their consent where the law or school policy requires it (see section 5);
- who it gives access to, and making sure its staff follow these Terms;
- keeping its own copies of important records. The Service is not a long-term archive, and we recommend downloading results you need to keep.
5. Student data (data processing)
- Roles. The school is the data controller of student data and we are its data processor under the Data Protection Act, 2012 (Act 843). We handle account and security data about users as a controller (see our Privacy Policy).
- Instructions. We process student data only to provide the Service to the school and on its documented instructions (including its use of the features), and not for our own purposes. We will tell the school if we think an instruction would break the law.
- The school's promises. The school confirms that it has the right to give us the student data, that the data is limited to what mock exams need, that students and their parents or guardians have been informed, and that consent has been obtained where required. This is especially important because most students are children. The school must not upload sensitive personal data (for example health or religion).
- Confidentiality and security. Anyone at EduMock who can reach student data is bound to keep it confidential. We use reasonable technical and organisational measures described in our Privacy Policy, including access controls, password hashing, rate limiting and an audit log.
- Helpers. We may use a hosting provider and similar service providers who are bound to protect the data. We remain responsible to the school for them.
- Help with rights and incidents. We will help the school answer requests from students, parents and guardians to see, correct or delete data, and we will tell the school without undue delay if we learn of a breach affecting its student data.
- End of service. When the school stops using the Service or asks us to, we will, within 90 days, delete the school's student data or return it in a usable format (such as Excel), unless the law requires us to keep it. Copies in backups are overwritten in the normal cycle.
- Checking. On reasonable notice, we will give the school the information it reasonably needs to check that we follow this section.
6. Acceptable use
You must not:
- enter false, misleading or invented marks or student details, or alter results to deceive anyone;
- access another school's data, try to get around access limits, or use someone else's account;
- upload unlawful, harmful or infringing material, or malware;
- copy, resell, scrape or reverse-engineer the Service or its question or grading material, except as these Terms allow;
- overload, probe or attack the Service, or try to guess verification codes or passwords;
- use student data for anything other than the school's own educational purposes, including marketing or sharing it with third parties without the legal right to do so.
7. Mock results are not official
EduMock produces mock examination scores, grades, aggregates, positions and analysis from the marks that schools enter and the grading rules in the Service. They are practice results for guidance only. They are not results of the West African Examinations Council (WAEC), the Ghana Education Service or any other examining body, and EduMock is not connected with those bodies. They do not predict or guarantee any real examination result or placement. Schools and parents should not rely on them as official records, and should tell students and parents so. We are not responsible for decisions made from mock results.
8. Pro plan and activation codes
- Pro features are unlocked by an activation code issued by Super Admin. A code can be used once, is for the school that redeems it, cannot be transferred or sold, and unlocks Pro for the period shown when it is redeemed (normally one year). Redeeming another code adds to the time left.
- When Pro ends, the school returns to the free plan. Data is kept, but Pro-only features stop working until Pro is renewed, and a school-defined grading scale is no longer applied to new results.
- We may cancel a code that was issued by mistake, obtained improperly or used in breach of these Terms.
9. Fees and payments
Access to a mock may be free, or may require payment, as agreed between the school and us when the mock is offered. Where fees apply, the amount, currency (Ghana Cedi unless stated) and payment method are shown on the invoice or payment screen. Payments may be confirmed manually and access starts once we confirm them. Unless the law says otherwise or we agree otherwise in writing, amounts paid are not refundable once a mock or code has been activated. Where a mistake on our side leads to a wrong charge, we will correct it. Taxes, if any, are shown separately.
10. Ownership and content
We and our licensors own the Service, its software, design, branding (including the EduMock name and logo), question and grading material and documentation. We give you a limited, non-exclusive, non-transferable right to use the Service for your school's own mock-exam work while these Terms apply.
The school keeps ownership of the content it enters (student records, scores, logos, photographs). The school gives us a limited right to store, process, display and print that content only as needed to run the Service for it, and to make backups. You confirm you have the right to give us that content.
11. Availability and support
We try to keep the Service available and may carry out maintenance, sometimes without notice. We do not promise it will be uninterrupted or free from errors. Please do not leave score entry to the last minute. Support is given by email on a reasonable-efforts basis.
12. Liability
- The Service is provided "as is" and "as available". To the fullest extent the law allows, we give no warranties other than those that cannot be excluded.
- Nothing in these Terms limits liability that cannot be limited by law, such as for fraud or for death or personal injury caused by negligence.
- Subject to that, we are not liable for indirect or consequential loss, loss of profit, reputation or goodwill, or for loss caused by wrong marks entered by a school, by decisions taken from mock results, by events outside our reasonable control, or by your breach of these Terms.
- Subject to the first two points, our total liability to a school for all claims connected with the Service in any 12 months is limited to the fees that school paid us in those 12 months (or, if it paid nothing, to GH₵ 500).
13. Your responsibility for claims
The school will compensate us for losses, costs and claims (including reasonable legal fees) that arise from a third party's claim that the school added student data without a lawful basis or the required consent, or from the school's breach of these Terms, except to the extent we caused the loss.
14. Suspension and ending
A school can stop using the Service at any time and ask us to close its account. We may suspend or end access immediately if you break these Terms, put others or the Service at risk, or the law requires it; where reasonable we will tell you why and give you a chance to fix the problem. On ending, section 5 (end of service), and sections that by their nature continue (ownership, liability, claims, governing law) stay in force.
15. Changes to these terms
We may update these Terms, for example to reflect new features or changes in the law. The version and date are at the top. For important changes we will ask signed-in users to accept the new version and, where practical, notify administrators first. If you do not accept a change, you can stop using the Service and ask us to close your account.
16. Governing law and disputes
These Terms are governed by the laws of the Republic of Ghana. Please contact us first so that we can try to settle any dispute informally. If we cannot settle it within 30 days, the courts of Ghana have jurisdiction, unless we agree in writing to use mediation or arbitration under Ghana's Alternative Dispute Resolution Act, 2010 (Act 798).
17. General
- These Terms and the Privacy Policy are the whole agreement about the Service and replace earlier understandings.
- If part of these Terms is found unenforceable, the rest still applies.
- If we do not enforce a right straight away, we have not given it up.
- You may not transfer your rights under these Terms without our written consent. We may transfer ours to a successor of the business.
- Notices to you may be given by email, in the portal or by notification. Notices to us go to the email below.
